It is made available by BIMCO as an independent, supporting document to the BIMCO Shipman Emission Trading Scheme Allowances Clause 2023 and Shipman 2024.Commission Implementing Regulation (EU) 2023/2599 of 22 November 2023 [Implementing regulation – EU – 2023/2599 – EN – EUR-Lex (europa.eu)] stipulates that for a shipowner to pass the responsibility for EU ETS obligations on to the entity who has document of compliance responsibility under the ISM code then an express mandate is required.As we highlighted in our article here [Emission Trading Systems – BIMCO publishes four new clauses - NorthStandard (north-standard.com)], where the parties choose that the manager is to be the responsible entity for compliance with the EU ETS obligations, the abovementioned Implementing Regulation requires that a signed document, which clearly indicates that the manager has been mandated by the shipowner to be responsible for compliance with the EU ETS, is to be provided to the relevant administering authority.BIMCO does make the point that the relevant administering authority of a member state may have its own individual requirements which will have to be complied with.For more read here.
