The new regime will apply to pollution incidents taking place between January 1, 2013 and December 31, 2013. The fine amounts per gross ton will apply as follows: Petroleum and petroleum derivatives (crude oil, fuel, bilge, sludge, slop, refined products, oily waste etc.) discharged into the sea by tankers: 1. Up to 1,000 (inclusive) gross tons: 67.69 TRY 2. Between 1,001 and 5000 (inclusive) gross tons: 16.89 TRY 3. Over 5,000 gross tons: 1.63 TRY Dirty ballast discharged into the sea by tankers: 1. Up to 1,000 (inclusive) gross tons: 50.76 TRY 2. Between 1,001 and 5,000 (inclusive) gross tons: 10.12 TRY 3. Over 5,000 gross tons: 1.63 TRY Petroleum derivatives (bilge, sludge, slop, fuel, oily waste etc.) or dirty ballast discharged into the sea by ships or other sea-going vessels: 1. Up to 1,000 (inclusive) gross tons: 33.83 TRY 2. Between 1,001 and 5,000 (inclusive) gross tons: 6.74 TRY 3. Over 5,000 gross tons: 1.63 TRY Solid wastes or domestic waste waters discharged into the sea by tankers, ships or other seagoing vessels: 1. Up to 1,000 (inclusive) gross tons: 16.89 TRY 2. Between 1,001 and 5,000 (inclusive) gross tons: 3.34 TRY 3. Over 5,000 gross tons: 0.65 TRY If the polluting vessel discharges any dangerous substances or disposals (defined as those which would have negative physical, chemical and/or biological effects on the local ecology) in to the sea, the fine will be calculated at 10 times the published rate for the category of petroleum or petroleum derivatives fines. Should a ship repeat the pollution offense within 3 years, the fine amount for the second offense will be doubled, and fines imposed for each subsequent offense will again be doubled. Members are therefore encouraged to work closely with the Managers and any instructed correspondent to promptly address and investigate the incident and, if appropriate, to settle such fines within the specified 30-day period. Local vessel agents, upon their nomination, often notify vessel owners or the masters of vessels transiting or waiting at anchorage or calling at Turkish ports, especially prior to the vessels’ entering the Canakkale (Dardanelles) Straits, that masters should take precautions not to cause any pollution. Accordingly, it is recommended that Members and their masters exercise the utmost care and effort to take all steps not to cause any pollution by leakage/spillage of any kind of materials (i.e., paint, oil, bilges, clean ballast, dirty ballast, all kind of residues, garbage, dirty water, sewage water, laundry water with detergent, lavatory soap water, shower water, dust, rust etc.) during such transits. Members are encouraged to follow the foregoing guidance
