2025년 1월 10일 FD&D 가입 Member 제위 Class 6 – FD&D (Freight, Demurrage and Defence) Rule 20.1.10 (전염성 질병 위험) 관련 2025/26PY 가입증서에 대한 배서 Club의 2025년1월9일자 회람에서 언급 드렸듯이, 2025년1월7일 화요일에 개최된 이사회에서 Class 6의 Rules 개정안이 만장일치로 통과되었습니다. 전염성 질병 위험에 관한 2025/26PY의 Class 6 (FD&D) 가입증서에 대한 배서가 별첨되어 있습니다. 코로나바이러스와 같은 전염성 질병 위험과 관련하여, 이사회는 클레임당 USD 2 Mil. 또는 연간 누적으로 USD 4 Mil.을 한도로 Member에 담보 제공하는데 동의하였습니다. 또한, 전염성 질병 위험에 대한 담보 제한 규정 또는 조항에 따라 Club에서 제공하는 모든 담보와 보험은 연간 누적으로 USD 10 Mil.로 추가 제한됩니다. 별첨의 배서는 Member의 가입증서상에 명시된 경우에 적용됩니다. Freight, Demurrage & Defence – Communicable Disease Risks Endorsement Policy Year 2025/26 Risks Period: 12:00:00 UTC 20 February 2025 to 12:00:00 UTC 20 February 2026 It is hereby agreed that Rule 20.1.10 Declared Communicable Diseases is deleted and replaced by the following new Rule 20.1.10 Communicable Disease Risks: 20.1.10 Communicable Disease Risks Liabilities directly arising from any transmission or alleged transmission of a Declared Communicable Disease; Provided always that: 20.1.10.1 In the event that the World Health Organization (‘WHO’) has determined an outbreak of a Communicable Disease to be a Public Health Emergency of International Concern (a Declared Communicable Disease), recovery under this insurance in respect of any loss, damage, liability, cost or expense otherwise recoverable hereunder directly arising from any transmission or alleged transmission of the Declared Communicable Disease shall be limited to the amounts stated in Rule 20.1.10.7. 20.1.10.2 The limitation in Rule 20.1.10.1 shall not apply to liabilities which arise directly from an identified instance of a transmission of a Declared Communicable Disease and it is established to the satisfaction of the Managers that such transmission took place before the date of determination by the WHO of the Declared Communicable Disease. 20.1.10.3 Irrespective of whether the requirements of Rule 20.1.10.2 are met, there shall in any event be no recovery from the Association for any: 20.1.10.3.1 liability, cost or expense to identify, clean up, detoxify, remove, monitor or test for the Declared Communicable Disease whether the measures are preventative or remedial; 20.1.10.3.2 liability for or loss, cost or expense arising out of any loss of revenue, loss of hire, business interruption, loss of market, delay or any indirect financial loss, howsoever described, as a result of the Declared Communicable Disease; 20.1.10.3.3 loss, damage, liability, cost or expense caused by or arising out of fear of or the threat of the Declared Communicable Disease. 20.1.10.4 In this Rule 20.1.10, Communicable Disease means any disease, known or unknown, which can be transmitted by means of any substance or agent from any organism to another organism where: 20.1.10.4.1 the substance or agent includes but is not limited to a virus, bacterium, parasite or other organism or any variation or mutation of any of the foregoing, whether deemed living or not, and 20.1.10.4.2 the method of transmission, whether direct or indirect, includes but is not limited to human touch or contact, airborne transmission, bodily fluid transmission, transmission to or from or via any solid object or surface or liquid or gas, and 20.1.10.4.3 the disease, substance or agent may, acting alone or in conjunction with other comorbidities, conditions, genetic susceptibilities, or with the human immune system, caus
